Terms and Conditions of Use
1. Who we are and what we do
Vukea ("we", "us", or "the platform") is a technology platform operating via vukea.com that connects individuals wishing to request a ride (passengers) with individuals wishing to offer independent transportation services (drivers), through applications and web panels.
Vukea is not a transportation company. The transportation service is provided directly by the independent driver, who is responsible for the vehicle, the route, and compliance with applicable traffic regulations. Vukea operates from New York and adheres to applicable local regulations, including NY T&LC Base Number B03591.
2. Acceptance of Terms
By registering as a passenger or driver, accessing your account, or using the platform, you declare that you have read and accepted these Terms and Conditions, as well as the Privacy Policy and the Cookie Policy.
If you do not agree with any part of these Terms, you must not use the platform.
3. Requirements to use the platform
3.1 Passengers
- Be at least 18 years old (or the legal age of majority in your country).
- Provide real and updated data (name, email, phone, etc.).
- Do not share your account or credentials with third parties.
3.2 Drivers
- Meet the legal driving age in your country.
- Possess a valid driver's license, vehicle documents, and required insurance.
- Upload and keep updated the documents requested on the platform.
- Comply with traffic laws, safety standards, and any applicable local regulations.
4. Account, Security, and Veracity of Information
Each user is responsible for maintaining the security of their account, login credentials, and the devices from which they connect. Any activity that occurs under your account se presume realizada por ti, salvo que nos notifiques inmediatamente sobre un uso no autorizado.
Vukea may suspend or close accounts when it detects fraudulent use, non-compliance with these Terms, or security risks to other users.
5. Platform Use and Expected Conduct
By using Vukea, you agree to:
- Not use the platform for illegal or prohibited purposes.
- Not harass, discriminate, threaten, or physically or verbally assault other users.
- Not damage, modify, or attempt to access third-party systems or accounts without permission.
- Respect safety guidelines and traffic regulations.
Passenger Conduct
- Provide real and safe pickup and destination points.
- Not soil or damage the vehicle.
- Respect schedules and not excessively cancel without just cause.
Driver Conduct
- Drive prudently and responsibly.
- Not consume alcohol, drugs, or other substances that impair driving.
- Respect the passenger, their privacy, and belongings.
- Not divert the route unjustifiably or alter fares.
6. Bookings, Pricing, and Payments
Fares may be calculated based on various parameters (distance, time, demand, promotions, tolls, etc.). Before confirming a trip, the passenger will see an estimate or approximate fare.
The passenger authorizes Vukea and its payment providers to charge the corresponding amounts for the transportation services rendered, tips (if applicable), and other associated charges.
Vukea may retain a commission for the use of the platform and associated services. The commission amount will be communicated to the driver within their panel and/or when accepting trips.
7. Cancellations and No-Shows
Cancellation policies and charges for no-shows may apply, which will be communicated in the app or on the website. These policies may vary by city or country.
8. Rating and Review System
Passengers and drivers can leave ratings and comments about their experiences. These ratings help improve service quality.
Vukea may intervene and remove comments that contain offensive or defamatory language, or that do not comply with acceptable use policies.
9. Intellectual Property
The "Vukea" brand, logo, platform design, texts, images, and other content are owned by Vukea or used under license.
You are not permitted to copy, modify, distribute, sell, or commercially exploit any content from the platform without prior written authorization.
10. Liability and Disclaimers
Vukea provides a technology tool to connect passengers and drivers, but does not guarantee the continuous availability of the service, nor the total absence of errors or interruptions.
To the maximum extent permitted by law, Vukea is not responsible for:
- Damages or losses arising directly from the transportation service (accidents, delays, etc.).
- Conduct, acts, or omissions of passengers or drivers.
- Data loss caused by external factors (network failures, providers, force majeure, etc.).
11. Personal Data Protection
The processing of your personal data is governed by our Privacy Policy, where we detail what data we collect, for what purpose, for how long, and what rights you have over it.
12. Modifications to these Terms
Vukea may update these Terms at any time. When this occurs, the new version will be published on this same page, and we will indicate the last update date.
If you continue to use the platform after changes are published, it will be understood that you accept the new Terms.
